1. Introduction and Acceptance
Welcome to DoWatermark. These Terms and Conditions ("Terms") govern your use of the DoWatermark website and software service (collectively, the "Service"), operated by Raphael Berrebi doing business as DoWatermark ("we," "us," or "our").
By accessing or using DoWatermark, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Service.
2. License Grant
Upon purchasing DoWatermark Pro, we grant you a non-exclusive, non-transferable, limited license to use the Service subject to these Terms.
- One-time payment: DoWatermark Pro is sold as a one-time purchase for lifetime access. There are no recurring subscriptions or hidden fees.
- Device limit: Each license key can be activated on up to 2 devices simultaneously. You may deactivate devices to activate on new ones.
- Personal and commercial use: You may use DoWatermark for both personal and commercial projects.
- Browser-based processing: All watermarking occurs in your browser. Your images never leave your device.
3. User Accounts and License Keys
After purchasing DoWatermark Pro, you will receive a unique license key via email.
- You are responsible for keeping your license key confidential and secure.
- Do not share your license key with others. Shared keys may be deactivated without refund.
- You may activate your license on up to 2 devices. Contact support if you need to transfer to a new device.
- License keys are non-transferable and cannot be resold or redistributed.
4. Prohibited Uses
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of DoWatermark.
- Modify, adapt, or create derivative works based on the Service.
- Share, sell, rent, lease, or sublicense your license key to any third party.
- Circumvent device activation limits or license validation mechanisms.
- Use the Service for any illegal, harmful, or fraudulent purpose.
- Upload or watermark content that violates intellectual property rights, privacy rights, or applicable laws.
- Attempt to overwhelm or disrupt the Service's infrastructure.
5. Intellectual Property
Your Content: You retain full ownership and rights to all images and content you process using DoWatermark. Because all processing occurs in your browser, we never have access to, store, or claim any rights to your content.
Our Software: DoWatermark, including its software, design, branding, and documentation, is owned by Raphael Berrebi and protected by copyright, trademark, and other intellectual property laws. Your license does not grant you any ownership rights to the Service itself.
6. Service Availability and Modifications
DoWatermark is provided on an "as-is" and "as-available" basis. We strive to maintain reliable service, but:
- We do not guarantee 100% uptime or uninterrupted access, though the browser-based nature of DoWatermark means it works offline after initial load.
- We reserve the right to update, modify, or discontinue features with or without notice.
- We may perform maintenance that temporarily interrupts access to license validation or download features.
- We are not responsible for issues caused by your browser, internet connection, or device compatibility.
7. Limitation of Liability
To the maximum extent permitted by law:
- DoWatermark is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We are not liable for any data loss, business interruption, lost profits, or consequential damages arising from your use or inability to use the Service.
- Our total liability to you for any claim related to DoWatermark is limited to the amount you paid for your license (US $5).
- Because all processing occurs in your browser, we have no access to or responsibility for your images or watermarked output. You are solely responsible for backing up your work.
8. Termination
We reserve the right to suspend or terminate your license if you violate these Terms, including:
- Sharing or reselling your license key.
- Circumventing device limits or license validation.
- Using the Service for fraudulent or illegal purposes.
- Engaging in abusive refund behavior.
Upon termination, you will lose access to DoWatermark Pro features and revert to the free version (1 image limit). Sections of these Terms that by their nature should survive termination will remain in effect.
9. Payment Terms
DoWatermark Pro is sold for a one-time payment of US $5.
- Merchant of Record: All payments are processed by Paddle.com Market Limited ("Paddle"), our authorized reseller and merchant of record. Paddle handles all payment processing, billing, and customer payment support.
- Sales Tax/VAT: Prices may include applicable sales tax, VAT, or other taxes based on your location. Paddle automatically calculates and collects these taxes.
- Payment Methods: Paddle accepts major credit cards, PayPal, and other payment methods depending on your region.
- No Subscriptions: DoWatermark Pro is a one-time purchase. There are no recurring charges or automatic renewals.
10. Refund Policy
We offer a 14-day money-back guarantee for all DoWatermark Pro purchases. If you're not satisfied, you can request a full refund within 14 days of purchase, no questions asked.
For complete refund policy details, see our Refund Policy page.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Israel, without regard to conflict of law principles. However, we recognize and respect consumer protection laws worldwide, including:
- EU Consumer Rights Directive (for European customers)
- GDPR (General Data Protection Regulation) for data privacy
- Other applicable consumer protection laws in your jurisdiction
Any disputes arising from these Terms or your use of DoWatermark shall be resolved through good faith negotiation or, if necessary, through applicable dispute resolution mechanisms in your jurisdiction.
12. Modifications to Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. We will notify users of material changes via email or prominent notice on our website. Continued use of DoWatermark after changes constitutes acceptance of the updated Terms.
